What does Police Director Larry Godwin and The City of Memphis have to hide that they have join forces to violate the Constitutional rights of a local blogger whose sites speaks out against the misdeeds of the department and attacks the shady dealings of Godwin.
The site is ran by a blogger who calls himself or herself,Dirk Diggler who may or may not be a former police officer. It's very possible that Dirk may also be a current officer who is a high ranking officer who is close to Godwin and knows how corrupt he is,and for this reason Godwin is running scared.
The site MPD ENFORCER2.0 is heavily visited by local police officers who state their disgust for Godwin and his command staff. While Godwin seeks to find out where his leaks are he is seeking to violate the First Amendment by using tax payers dollars to quash Freedom of Speech. Godwin who for some unknown reason has Willie Herenton kissing his ass knows that he could soon face indictment if what police officers are saying is true when it comes to his involvement with former President of The Memphis Police Association Tommy Turner and missing thousands of dollars from that organization. Is This what Godwin is scared of?
Could he be scared that the public may find out that maybe the reason that Willie won't touch him is because he as the head of Special Operations covered the killing of a man several years ago on the Expressway by Andrea Herenton, Or that when it was announced that Janice Pilot would replace James Bolden as Police Director Bobby Todd who was over the traffic division and a close associate of the mayor walked Godwin into the mayor's office and reminded Willie about the favor that had been done on his behalf that suddenly changed his mind about who would take command of the police department.
Maybe Godwin doesn't want it discuss how he recently attempted to fix the traffic ticket of the owner of a local restaurant by sending his deputy chief Jim Tusant into Judge Jayne Chandler's court and got the ticket dismissed from the Olive Branch resident who was going 64 in a 45 mile zone. Judge Chandler saw what Tusant did and placed the case back on her docket and sent Godwin a very strong letter also asking him to appear in her court. The case was reset for August 8,2008. maybe Godwin can also explain why the business owner is being represented by the Memphis Police Association's attorney Ted Hansom.
Having this idiot attempting to come after me in the past I know that there is nothing that the courts can do to force AOL to reveal who Dirk happens to be. Dirk is using the site as a news source and thus is protected by the Tennessee Shield Law. But the main thing that protects Dirk is the Constitution and the right to free speech. MPD ENFORCER 2.0 is not forced upon anyon and a choice has to be made to go to the site thus Godwin if he does not like what is on the site has the right to stay his ass off.
But the question must be asked why are taxpayers being forced to pay for Godwin's lawsuit? Does not Herenton have the balls to tell Godwin no? The members of the city Council have the responsibility to protect the city from this type of action from Godwin and should be questioning why taxpayers dollars are being so misused. Dirk and I don't always agree on issues and the site has attacked me in the past, While I may not have liked what was said I join in the fight for the site to have the right to do so.

Also, I'd be quite interested to know why Chancellor Kenny Armstrong would agree to keep the complaint filed by Godwin sealed.

Sounds like Gestapo tactics used by the Germans. The internet is international and they may suspect that the subpoenaed blogger may reside outside the US and be a foreigner. If that is true then I don't think that that blogger isn't protected under our laws. If his/her identity is exposed by AOL then they will shut him down and turn him over to authorities. This blogger if employed might find himself then unemployed. If he/she drives on the street they might find them arrested or worse. Didn't I read that Godwin was a former undercover detective? If so, then he has underground connections with some not-so-nice people who are capable of not only shutting this blogger down but snuffing him out too. This blogger must have hit a nerve. Whoever they are they know too much and have probably left the country. Godwin is letting them know by his lawsuit that you can run but you can't hide. The internet has totally changed the playing field. The outcome of this dungeons and dragons game is going to be interesting. I sure wouldn't want to see it played out live, but I'm glad to have a front row set via the internet.

Once again you haven't done any fact checking. Under the Uniform Interstate Depositions and Discovery Act, which is law in Tennesee, AOL is compelled to release the information requested by Director Godwin.
You are partially correct in that a Virginia court can squash the subpeona like in the IPA vs. May case in 1999. But, this scenario is highly unlikely after the Virginia Supreme Court decision in the 2002 AOL v. Nam Tai case.
In that case the lower trial court and Virginia Supreme Court essentially decided that AOL was required to comply with the law and divulge the information requested.
We live in a common law society, meaning when the higher courts make a ruling on a particuler issue it becomes law.

Kenon, if I lived as poorly as you live I would surely change my tune.
He's not paranoid, so much as insecure, and like all people with power who are insecure, he is destructive AND self-destructive. He wants everyone to fear him the way he fears others. For Godwin, no one has to be against him at all; he is just full of hate. He's been like this for years. To me, it is not surprising the MPD has spawned (or encouraged) a man like Godwin to keep doing what he does; the department is full of people just like him (and a few very good people wearing the blue as well). For that matter, the Mayor is just like him.The guy that beat up the transvestite was essentially Godwin with less rank. Difference is, Godwin can beat people up with the "legitimacy" of his authority, the mayor's consent, and the people's apathy. Ironic that Godwin gets his "legitimacy" many times by firing officers like the one who beat up the transvestite (hypocritical, considering they are emotional twins), as well as officers he doesn't deserve to be in the same species with, let alone judge. Luckily, In addition to having his own hide spared on several occasions by those same officers, he is spared the intelligence necessary to understand his own nature, and the conscience required to wonder why. Remember that when the child had to tell the Emperor he had no clothes, it was because the Emperor was too stupid and detached from reality to realize it himself.

Also included in the sealed portion of the subpoena, Godwin contends still contends that the City Server was hacked, but, now added is that certain emails that were sent from his computer to media outlets were not sent by him even though they were sent from his computer denoting his email address.
Common sense would tell you that his former administrative assistants Jamie Whitney, or Vince Higgins used his computer to send these emails. Common sense would also tell you that if the City Server was actually hacked, the system would be shut down and the FBI would have been called in to find the identity of the hacker.
If Godwin would have thought far enough ahead, he could have called in not only the FBI, but TBI, CIA, ATF, ICE, NIS, Secret Service, USMC, Haney & Associates, US Army, USN, USAF, USCG, Homeland Security, US Customs and Border Protection, and even the Massad
( the Israeli Secret Service ), to find out who Dirk Diggler really is.
Well, he did not think that far ahead now he and Willie will have their asses handed to them when Paul Levy, and the numerous ACLU Attorneys get through with them. Regarding Michael Simon's death and the obvious Memphis police coverup to protect Andrea Herenton, daughter-in-law of Willie Herenton. Adding to the Numerous facts mentioned in previous blog comments, disposal of evidence (Simon's car), discrediting eyewitnesses, etc. I will like to bring to mind the 911 call(s) which on-scene witnesses claimed to have made providing evidence that Andrea Herenton caused his death. Those 911 calls disapeared, just like Simon's car ! The public was told there was a 911 voice recording failure which just so happened that those 911 calls related to that event were lost !! Ok, I see, millions of dollars out of taxpayers pockets used for 911 system and there is no backup voice recording system ?? And, when the voice recording system failed there was no mechanisim in place to alert supervisors ? Folks, we have a criminal conspiracy here that runs from the Mayors office, through the Police Directors office, down to the 911 management system. Just like others have asked, Why is this not already been investigated by the TBI and FBI ?? Are they too busy scratching their heads over why someone forgot to build the Transit terminal at the FedEx forum ?
