LAWSUIT TO KEEP MYRON LOWERY FROM BEING BOTH MAYOR PRO TEM AND A COUNCIL MEMBER TO BE FILED IF HERENTON LEAVES OFFICE PRIOR TO FEBRUARY 2010



A letter has been sent to Memphis mayor Willie Herenton by attorney Javier Bailey informing the mayor that he has been retained by the Memphis office of Rainbow PUSH. Bailey informs the mayor that after careful consideration and conversation with the leaders of the group it is believed that Myron Lowery's ability to remain on the Memphis city council and also serve as Mayor Pro Tem which places him in a position in both the executive and the legislative branches of government absolutely abridges separation of powers.

The letter goes on to request that the mayor remain in office until February 2010 to avoid the $1 million price tag of a special election and a charter crisis.

The mayor is informed that should he not remain in office until February 2010 that a lawsuit will be filed in Chancery Court where Rainbow PUSH will seek a declaratory judgement where the city will be enjoined from violating the separation of powers provision of the city charter. The lawsuit will be filed the moment mayor Herenton vacates his office if its prior to February of 2010.

Old Javy Bailey may actually have one here that he could win, which would be his first successful lawsuit. But wait, isn't his license revoked? With two losers like Rainbow PUSH and Bailey teamed up, they may even lose this one.

As soon as I saw the quality of the preacher brigade and heard of their plans to use Xavier Bailey the joke became apparent. You have to know the strength of their suit to have an "attorney" like him. WTF would their standing be as not for profit directors?

By the way, Jay, did you ever pay your taxes? You were listed in the Memphis Business Journal as having a tax lien.

Hiring the Jav is like wearing a sandwich board with the text message, "BOUND TO LOSE". Were I to be arrested for a minor offense like shoplifting one item at a Dollar Store, I would plead guilty and accept life in prison before engaging the Jav, going before a jury and receiving a verdict of electrocution which would surely be the jury verdict where the Jav pleaded my case.

Who will take over after he is gone if he stays until Feb ? I dont know a lot about politics. I just know i dont want to see Lowery in Dr. Herentons seat for one day.

I am starting to see how phoney Myron Lowrey really is. He should have not voted on the whole issue of whether Herenton should have to leave by July 10 or July 30. To me him siding with the white counselman shows his true colors. Thad, you were right about that guy he is an oppurtunist.

Thad, the thing you keep harping on is a black consensus candidate, and how the community has got to band together to develop one.

Lets face facts, if it hasn't happened by now, it simply ISN'T going to happen.

The community has had YEARS to develop such a candidate. It hasn't done so after all these years.

What makes anyone think it will happen in two weeks ?

At the end of the day, the black community is apathetic, cares less about solidarity and prefers to "Showboat" and talk loud without doing anything of substance.

Your children are a perfect example. Teenagers are the ones committing the majority of the murders, and yet the fathers are NOWHERE to be found, and the "Auntees" are rasing the kids.

You can't even control your own children, much less rally around a single consensus candidate.

Lets face it, it just isn't going to happen.

Lowery can only serve for twenty days until council appoints an interim mayor.

The short window is the very reason the council chair can hold both positions simultaneously - and temporarily.

Thad, I would like to see your lawyer Bailey run because he really has taken some tough cases where discrimination has been involved against a minorities. We need a scrapper in the mayor office like this guy because he will speak out for social justice. Bailey has always been a defense attorney that went after the city when they have abused there power and I like that. Most defense attornies are natural fighters and that is what you need in the mayor office. It will take a scrapper like this guy to finally get the black community of Memphis social justice.

As I have said before Wharton has been a prosecutor in his past, which would be the total opposite of Bailey's profession, because Wharton probably has done alot to keep us in jail and oppress are people. I could be wrong about this observation of Wharton's career, but that is my feelings about prosecutors. I respect the law but it takes a black man with a mindset that is alot diffrent than mine to be a prosecutor. To me are laws are built for the black man to not get a fair shake in life. It is really funny that I have these beliefs, my wife is a part of that system and me and her go back and forth about how unfair it is to minorities.

I would really like to see Bailey give it a run because that is who we need in office. The sad thing is that Wharton has a whole lot of name recognition and he is popular amongst white people which should really scare the heck out of us minorities. Wharton is not going to rock any boat if he gets in there and white folks will probably love him. He is meek negro and I cant stand a meek negro.

Before this is all over, we might create a new public office, Vice-Mayor. I don't think its a good idea for a public official to simultaneously wear two hats when they are in two branches of government. Lowery will a lame duck councilman.

The Jav claims in his letter to Willie that he was retained to review the charter, but he does not say he was retained by PUSH.
Maybe it was Joe Cooper that retained him.

The Jav states in his letter that he discussed the matter with PUSH. Sounds to me like this is one of the Jav's mentally unbalanced forays into never never land. I can't imagine the Rainbow Push organization retaining Javier Bailey, and the Jav didn't say he was retained by them.

I could easily call the White House and talk to anyone on the phone then try to project that I talked to the White House about
whatever I would want to bullshit about. This is just some more of the Matthews/Javier hogwash.

All that I gleaned from Jav's letter to Willie was a request for Willie to stay around so as to keep Lowery from dumping those worthless Willie appointments.

The suit that needs to be filed is against the City over all votes cast by Janis Fullilove while on the Council and Charter Commission. She is disfunctional by admission and before treatment used the same flawed logic that got her in trouble with the law over drinking/driving and fraudulent license application. How good could those votes be?

Even worse, his paying his lawyer and also the lawyer for Joe Lee almost a half million dollars. Then a citizen files suit. Thank the Lord for that citizen, but there should have been a better way. For sure it would have been to not given have him that first job with the school system. Willie should have been out there hi jacking cars or just fighting with his fist in some smelly South Memphis Bar.

If there is going to be a lawsuit, how about one against Willie for breach of contract and make him pay for the election. He ran and won and has a duty to serve his term.(Although I am glad as hell he is gone.) By choosing to resing early, he breached his contract with the citizens. He should pay for his breach. We would not have this expense but for his vane and arrogant ambition. He wants to indulge his delusions of grandeur, let him pay for the costs of the election.
